Case summaries published without amounts

Poynter & Bucheri has also described the following cases on pb-law.com/case-results without publishing the amounts.

Wrongful death: pickup truck hit by a semi

Our client and his wife were stopped in interstate traffic behind an earlier crash when a semi driver failed to slow and struck their pickup. His wife was killed; he was seriously injured and trapped for close to 90 minutes. The firm had a trucking engineer inspect the semi, which turned out to have faulty brakes, and retained a forensic psychiatrist and an Indiana University economist on the client’s injuries and losses. The case was resolved at mediation before a lawsuit was filed.

Dram shop: pedestrian struck after a night of drinking

Our client suffered a severe traumatic brain injury when he left a police stop on foot and was struck by vehicles while crossing a highway. The firm traced potential liability to a bar that may have served him while he was already intoxicated earlier that night. The trial court granted the defense summary judgment, our clients won on appeal, and the case later settled before the reset jury trial.

Trip and fall: store entrance threshold

An elderly customer tripped on the entrance threshold of a big-box clothing store, broke her hip, and needed several surgeries. The firm sued both the store and the landlord, and an engineer’s inspection found the threshold did not comply with code. Both defendants settled after receiving the report.

Product liability: delivery truck lift gate

A worker delivering office equipment lost part of a finger in the lift gate of a rented delivery truck. The firm sued the rental company and the lift gate manufacturer and, with an engineering expert, showed the lift gate was negligently designed and maintained. Both defendants settled.

Failure to supervise a child

A boy’s hand was badly mangled by the rope during a tug-of-war event run by a children’s entertainment venue. The firm argued the venue failed to supervise him, failed to train its staff, and ran the event negligently. The case settled the day before the jury trial.
