Avon's traffic problems mostly come down to one road. Rockville Road, which is U.S. 36, carries almost everything east and west through town, and the busy north-south roads all have to cross it. If you got hurt on or near Rockville Road, or on one of the county roads that feed it, here's how things usually go. You don't have to come to an office. We can do your consultation by phone or video, and you can sign up by e-signature.

The intersections Avon itself has flagged

When the Town of Avon wrote its 2019 Thoroughfare Plan, its consultants pulled three years of state crash data (July 2014 to June 2017) and ranked intersections by crash rate. If you drive here every day, you'll know a few of the names near the top:

  • County Road 100 South and Dan Jones Road had the highest crash rate in the study.
  • U.S. 36 and Ronald Reagan Parkway came in second.
  • County Road 100 North and Dan Jones Road was third.
  • U.S. 36 and Dan Jones Road also made the top ten.

The same plan named Rockville Road at Ronald Reagan Parkway, at Raceway Road, and at County Road 525 East as places that already carry more traffic than they were built for. INDOT has pointed to high crash rates along the U.S. 36 corridor as one reason for its planned work there. Those numbers are a few years old, and the town has grown a lot since. Treat them as a map of the trouble spots, not a current count.

Other roads that matter here

State Road 267, called Avon Avenue through town, runs north toward Brownsburg and I-74 and south toward I-70 and Plainfield. Ronald Reagan Parkway does the same job on the east side, and it's how a lot of truck traffic gets between the warehouses near the airport and I-74. Go south far enough on either one and you hit U.S. 40 and I-70. So a crash in Avon is just as likely to involve a semi as a minivan on the school run.

Getting the crash report

Inside town limits, the Avon Police Department takes most crash reports. Its administrative office is at 6550 E. U.S. Highway 36. The town's website says officers have up to three working days to finish a report, that a copy costs $10 from the department, and that you can also buy it online through the state's BuyCrash site for $12. Outside town limits, the Hendricks County Sheriff's Office in Danville usually writes it. On I-70 or I-74, it's often the Indiana State Police. Our crash report guide has the details. Read it as soon as you get it. If the other driver's side of the story made it in and yours didn't, we'd want to fix that early.

Hospital care close to home

IU Health West Hospital is right in Avon, at 1111 N. Ronald Reagan Parkway, with a 24-hour emergency department. From the town hall area it's about 10 minutes. Hendricks Regional Health has emergency rooms in Brownsburg and at its main hospital in Danville. Don't tough it out. A lot of people tell the officer at the scene they're fine, because they mean it at the time. Then the neck pain shows up the next morning. The insurance company will be quoting "no injuries reported" off that report for months. So get seen, and get it written down.

If the case goes to court

An Avon injury lawsuit is normally filed in the Hendricks County courts in Danville, at the courthouse on West Main Street. Danville is about 15 minutes west of Avon on U.S. 36. Sometimes Indiana's venue rules put the case in a different county, depending on who is being sued and where they are.

Cases we take from Avon

We handle semi and commercial truck crashes, car wrecks, falls at stores and restaurants, motorcycle crashes, pedestrian and bicycle injuries, dog bites, and wrongful death claims. Rear-end crashes are common in stop-and-go Rockville Road traffic. The other driver's insurer will sometimes say you stopped short. Here's the thing: Indiana law says a driver can't follow more closely than is reasonable and prudent (IC 9-21-8-14), so the driver behind you can still be held responsible, even if the insurer argues you stopped short. Under Indiana's comparative fault law, any share of fault assigned to you reduces your recovery.

Time limits in Indiana

You generally have two years from the crash to file an injury lawsuit (IC 34-11-2-4). The clock runs much shorter if a public vehicle or public property was involved, like an Avon town vehicle or a county snowplow: written notice to a local government is due within 180 days, and to the State within 270 days. And if the insurer says you were partly to blame, Indiana's comparative fault law (IC 34-51-2) cuts your recovery by your percentage of fault. It only bars you entirely if you were more at fault than everyone else put together.
